Terms and Conditions
This English translation is provided for convenience. Only the German version is legally binding.
Section 1 Scope and provider
These General Terms and Conditions apply to all orders placed via the MAISON HONNEUR online shop. The provider and contracting party is 247 Trading GmbH, Augsburger Str. 13, 85221 Dachau, Germany, represented by the Managing Director Miguel Tuschen, registered in the commercial register of the Munich Local Court under HRB 282913 (hereinafter “we”). MAISON HONNEUR is a brand of 247 Trading GmbH. Deviating terms of the customer do not apply unless we expressly agree to them.
Section 2 Conclusion of contract
The presentation of products in the shop does not constitute a legally binding offer but an invitation to order. By clicking the order button at the end of the checkout process, you submit a binding offer to purchase the goods in your shopping cart. Immediately afterwards you will receive an automatic confirmation of receipt by email, which does not yet constitute acceptance. The contract is concluded when we accept your order with a separate order confirmation by email or ship the goods. For payment methods where payment is triggered directly during checkout, the contract is concluded upon completion of the payment process.
Before submitting your order, you can check and correct your entries at any time using the usual browser and keyboard functions.
Section 3 Contract language and contract text
The contract language is German. We store the contract text and send you the order details and these Terms by email. You can view the Terms on this page at any time.
Section 4 Prices and shipping costs
All prices are final prices in euros and include statutory VAT. Shipping costs, which are stated in the shop and during checkout, are charged in addition: within Germany €4.95, free shipping on orders of €100 or more; for deliveries abroad €12.95, free shipping on orders of €150 or more. For deliveries to countries outside the European Union, customs duties, taxes and fees may apply, which are borne by the customer.
Section 5 Payment
The payment methods displayed during checkout are available. The purchase price is due immediately upon conclusion of the contract. Payment is processed by the respective payment service provider shown.
Section 6 Delivery
Every product is made and embroidered for you after your order. Delivery usually takes 5 to 15 business days within Germany and 7 to 20 business days for deliveries abroad, in each case from conclusion of the contract (for prepayment, from receipt of payment). If you order several items, delivery may be made in partial shipments; this does not incur any additional shipping costs for you.
Section 7 Retention of title
The goods remain our property until full payment has been made.
Section 8 Right of withdrawal
Consumers have a statutory right of withdrawal. Details can be found in our withdrawal policy.
Section 9 Warranty
The statutory warranty rights apply. Please report obvious transport damage or defects as soon as possible to info@maisonhonneur.com; your statutory rights remain unaffected. Thread colour, embroidery and fabric colour may differ slightly from the images due to made-to-order production and screen display.
Section 10 Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act. In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded.
Section 11 Dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
Section 12 Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of the country in which they have their habitual residence.
